Formal Escalation – Request for Human Review and Removal of 10-Day Selling Restriction | Item 298656583592 | Ref. 2-108507646466 Dear eBay Trust & Safety / Appeals Team, I am writing to formally escalate the 10-day selling restriction placed on our eBay account, linesonmy*face, concerning the following listing: Item: 298656583592 Product: Selsun Anti-Dandruff Shampoo 120 ml Reference ID: 2-108507646466 Policy cited: Prescription and Over-the-Counter Drugs Policy We respectfully but strongly dispute this enforcement action and request an urgent manual review by a senior member of the Trust & Safety / Policy team. eBay's notice itself states: “This determination was made using automation or artificial intelligence. This came to our attention through automated detection.” This is particularly concerning because the product in question is an ordinary commercially available anti-dandruff shampoo sold directly to consumers in India. It is not being represented by us as a prescription medicine, nor are we selling it as a professional-use pharmaceutical product. More importantly, there appears to be a very serious inconsistency in the application of this policy. Numerous identical/similar Selsun products remain available on eBay At the time of checking, we found numerous eBay listings for the same Selsun anti-dandruff shampoo, including listings from UK and US sellers: • eBay UK Item 157835963581 • eBay UK Item 158232523524 • eBay UK Item 318220452896 • eBay UK Item 800364911594 • eBay UK Item 800324675139 • eBay UK Item 800423049748 • eBay US Item 256275374649 – US seller offering Selsun shampoo manufactured in India • eBay UK Item 365794567195 • eBay UK Item 134722739710 – UK seller offering the same Made-in-India Selsun product, with substantial sales history One of these UK listings appears to have sold more than 1,000 units. This raises an obvious and important question: If Selsun Anti-Dandruff Shampoo is prohibited under eBay's Prescription and Over-the-Counter Drugs Policy, why are multiple other sellers currently permitted to sell the same product, including sellers based in the UK and USA? We fully understand that the existence of another seller's listing does not, by itself, establish that a product complies with eBay policy. However, when eBay imposes a severe 10-day account-wide selling restriction, hides all of a seller's other listings from search, and materially affects that seller's business, we believe eBay has an obligation to ensure that the underlying policy determination is accurate and consistently applied. The product is openly sold to consumers without a prescription The same Selsun anti-dandruff shampoo is openly available to consumers through Amazon India: Amazon India – Selsun Suspension Anti-Dandruff Shampoo: https://www.amazon.in/Selsun-Suspension-Dandruff-Excessive-Itching-Pack/dp/B07CJXFLQ7 This further supports our understanding that the product is sold as a consumer anti-dandruff shampoo in India and does not require the purchaser to provide a medical prescription. If eBay believes that a particular ingredient, concentration, destination-country regulation, or other specific characteristic of our Selsun 120 ml product makes our listing prohibited, then we respectfully request that eBay identify exactly what characteristic of Item 298656583592 caused it to violate the policy. A generic statement that “prescription and professional-use drugs are not allowed” does not adequately explain why this particular shampoo was classified as prohibited. The punishment is extremely disproportionate if the automated classification is incorrect This enforcement action does not merely remove one listing. eBay has imposed a 10-day selling restriction on our entire account and hidden our unrelated listings from search, causing potentially significant loss of sales and disruption to our business. That is an extremely serious commercial consequence arising from a decision which eBay itself confirms was generated through automated detection / artificial intelligence. We therefore believe that imposing such a significant account-level penalty without first ensuring that the product was correctly classified deserves immediate human review. We have always tried to comply with eBay's policies. If eBay identifies a genuinely prohibited product, we will of course respect the policy and will not relist it. What is difficult for us to accept is being severely penalised for selling a product that appears openly across eBay from numerous other sellers, while receiving no product-specific explanation as to why our particular listing constitutes a prescription or prohibited drug. We respectfully request the following A manual review of Item 298656583592 by a senior Policy/Trust & Safety specialist rather than relying solely on the automated determination. Confirmation of the specific ingredient, concentration, regulatory classification, destination-country restriction, or listing content that caused this Selsun shampoo to be classified as prohibited. A review of the comparable eBay listings referenced above so that the policy is applied consistently and fairly across sellers. If the automated system incorrectly classified our product, immediate removal of the 10-day selling restriction and restoration of our listings to search results. Removal of any associated policy violation/strike from our account history if this enforcement action is found to have been made in error. Written confirmation that this incident will not negatively affect our future account standing if the violation is overturned. We are not asking eBay to make an exception to its Prescription and Over-the-Counter Drugs Policy. We are asking eBay to determine whether the policy actually applies to this product and, if it does, to explain why it appears to be applied differently to numerous sellers offering the same product. As a seller, it is extremely difficult to operate confidently when one account can receive a serious 10-day restriction for a product while numerous identical products remain actively available for purchase elsewhere on the same marketplace. We therefore ask that this case not be closed with a standard policy response or another automated decision. Please escalate Reference ID 2-108507646466 for a genuine human review by an appropriate senior policy specialist and provide us with a product-specific explanation of the decision. We look forward to a fair and transparent review and, if the automated enforcement was incorrect, prompt restoration of our selling privileges. Kind regards, Sangeeta Kapoor For eBay account: ines*on*my*face
